Terms & Conditions

What are the terms for using this website?
By accessing and using this website, you agree to these Terms & Conditions. We may update content at any time without prior notice.
We aim to ensure all product descriptions and pricing are accurate. However, errors may occasionally occur and we reserve the right to correct them at any time.

All prices are displayed in Australian Dollars (AUD) and include GST unless stated otherwise.

We reserve the right to accept or cancel any order at our discretion, including where pricing errors or stock issues occur.

All payments are processed securely via Stripe. DishSmart™ does not store your payment details. Refunds are always processed back to your original payment method.

Orders are dispatched within 1 to 2 business days. Delivery typically takes 7 to 8 business days via Australia Post or our delivery partners. Shipping is a flat rate of $12.95, with free shipping available on selected bundle offers. Tracking details are provided once your order has been dispatched.

We do not offer exchanges for change of mind. Damaged or incorrect items must be reported within 7 days of receiving your order. Refunds are issued to your original payment method. All purchases are covered under Australian Consumer Law.

To the extent permitted by law, DishSmart™ is not liable for any indirect or consequential loss arising from the use of this website or our products.

DishSmart™ aims to make retailer supply simple, clear and commercially fair.

For approved retail and wholesale accounts, our standard supply terms generally include:

Orders
All orders are subject to written acceptance by DishSmart™. Purchase orders may be accepted by email or other agreed written confirmation.

Pricing
Wholesale pricing is quoted in Australian Dollars and is exclusive of GST unless otherwise stated. Final pricing is confirmed at the time of order acceptance.

Payment Terms
Payment terms may vary depending on retailer type, order volume and credit assessment.

As a general guide, smaller retailers and orders below 100 cartons are supplied on 14-day payment terms from invoice date. Medium to large retailers, or orders of 100 cartons and above, may be eligible for 30-day payment terms from invoice date, subject to credit application and approval.

Where credit terms are not approved or have not yet been established, orders will be supplied on cash terms. DishSmart™ reserves the right to suspend further supply where accounts exceed agreed payment terms.

Delivery
DishSmart™ can arrange door-to-door delivery to the nominated retail warehouse or store, subject to agreed freight arrangements. Delivery costs and terms will be confirmed at the time of order.

Order Changes & Cancellations
Orders may be amended or cancelled in writing before production or dispatch has commenced. Once production, packing or dispatch has commenced, cancellations may be subject to recovery of direct costs already incurred.

Risk & Ownership
Risk in the goods passes to the retailer upon delivery to the nominated location. Ownership of the goods remains with DishSmart™ until payment has been received in full.

Claims
Any claims relating to shortages, damage or non-conformance must be notified in writing within 7 days of delivery so they can be assessed promptly.

Overdue Accounts
DishSmart™ reserves the right to charge interest on overdue amounts where accounts exceed agreed payment terms.

Consumer Law
Nothing in these terms excludes rights or remedies available under the Australian Consumer Law.

Delays & Events Outside Our Control
DishSmart™ will make reasonable efforts to meet agreed delivery timeframes. However, DishSmart™ is not liable for delays or failure to supply where this is caused by events outside our reasonable control, including shipping delays, supplier interruptions, natural disasters, government actions or other circumstances beyond our control.

Limitation of Liability
To the extent permitted by law, DishSmart™’s liability is limited to replacement of the goods or refund of the purchase price. DishSmart™ is not liable for indirect, consequential or loss of profit damages. Nothing in these terms excludes rights or remedies available under the Australian Consumer Law.

For larger retail groups, distributors or national accounts, DishSmart™ may provide a separate written supply agreement or full Terms & Conditions of Sale.
